Exporting the personal data of a foreign national to one in San Marino is permitted as San Marino law (Law no. 70 of 23 May 1995 RSM) guarantees an adequate protection level for the person and his/her privacy.


Treatment holder

The treatment holder for data collected through this website is Ayjoy: it independently decides about treatment purpose and methods used and safety procedures to be applied to guarantee data confidentiality, integrity and availability.

Facultative or compulsory nature of providing data

Providing Ayjoy with your data as requested at different moments can be compulsory to fulfil purposes identified in information provided, or can be facultative.
The compulsory or facultative nature of conferring data is specified on the single occasions and a refusal to communicate some of your compulsory data makes it impossible to fulfil the main collection purpose (from buying products to assistance).
Providing Ayjoy with further data, other than what is marked as essential, is facultative and has no effect on fulfilling the main collection purpose.

User rights

- You always have the right to confirmation over whether your data is being handled or not, even if not yet registered, and to it being communicated in an intelligible manner.
- You have the right to receive information from Ayjoy on how we acquired your personal data; purpose and methods used to handle it; logic used if said data should be handled electronically; treatment holder identification data; indication of parties or party categories that said data can be communicated to. All that information is contained in this Privacy Policy.

Furthermore, you always have the right to ask Ayjoy to:
1) update, correct or integrate  your personal data;
2) cancel, make it anonymous or block it if handled in violation of the law, including data that does not have to be kept for the purposes for which it was collected and then handled;
3) declare that the operations listed in points 1) and 2) have been made known, including their content, to those who the data has been communicated or divulged to, except if that should be impossible or imply means that are not proportionate to the rights being protected.

You have the right to fully or partially oppose:
- handling of personal data concerning you, for legitimate reasons, even if needed for the collection purposes;
- your personal data being handled to send out advertising or direct marketing material, for market research of commercial communications.

The Ayjoy privacy policy in brief

The principles our privacy policy is based on are as follows:

1. handle data exclusively for the purpose and using methods illustrated in the information notes;
2. only use the data  for purposes other than those it was specifically provided for with the user’s consent;
3. only make said data available to third party companies for purposes that are instrumental for supplying the purpose requested and appointing a person responsible for handling it; not communicate, transfer or provide said data to third parties for their own purposes without the user being given prior notice and having given his/her consent;
4. respond to requests to cancel, modify, integrate data supplied, oppose handling of said data to send commercial and advertising material;
5. assure correct, fair data handling, protecting user privacy, with suitable safety measures to protect data confidentiality, integrity and availability.

Why and how we handle personal data

Personal data received is mainly handled electronically and telematically by  Ayjoy and other parties which, chosen for their reliability and competence, carry out instrumental operations for purposes strictly linked to using the website, its services and to buying products through the website.
Specific purposes for which data is handled are listed, each time, in information provided on Law no. 70 of  23 May 1995. In general, data is handled to supply the following services made available by accessing our website:

- registering with the website
- adhering to specific and further services;
- evading orders and connected activities;
- handling your requests: of a technical and/or commercial nature, on how your order is progressing and on any other relative information;
- making contact with the people running our services (e.g. Customer Care);

When handling the data that can, directly or indirectly, identify you, we try to respect a “strictly necessary” principle.

In some cases, as indicated in the notes, your data will be processed – with your specific consent – to create a profile based on your preferences and your purchases. This to send you targeted information for your needs and interests. The data holder can use the data to send advertising emails on its products and services, similar to what you have already bought, unless you refuse to permit said use.

Your data will only be communicated to third parties with your specific consent, except for when said communication is obligatory by law or is required for a purpose where interested party consent  is not required; in those cases, data can be made available for third parties which will handle it autonomously and only for specific purposes (for example, if required by the police or magistrate’s court or other competent entities or to fulfil obligations arising from the contract signed with you for payment of products purchased).

Any other handling purpose will be highlighted in the notes given and only carried out by Ayjoy with your prior consent (e.g to identify a single customer profile based on his/her preferences and purchasing habits).

However, there are handling needs where the law specifically excludes consent: for example, we would like to inform you that Ayjoy can handle your data without your consent when this is needed to fulfil a legal obligation or when this is necessary to fulfil contractual obligations taken with you (e.g. when you have bought products or asked to be able to use specific website services).

Finally, we would also like to inform you that your personal data will not be transferred abroad to countries that do not guarantee adequate protection.  If this should be necessary to supply services or conclude an agreement with Ayjoy to purchase some products, we assure you that data will only be transferred to countries that do not belong to the European Union and do not guarantee adequate data protection after Ayjoy has drawn up specific agreements with said parties conforming to applicable laws and regulations.

Ayjoy have to handle data belonging to third parties communicated directly by its users, for example if the person paying the price for a product is the not the same as the party said product is being sent to, or when the user decides to tell a friend about the Ayjoy service or the offer for sale of a specific product.

On these occasions, Ayjoy will make sure it sends the third party in question the information prescribed by art. 8,  Law no. 70,  23 May 1995(RSM) at the time it records said party’s data in its database, but it is your responsibility to obtain the consent of the person the data refers to before giving it to Ayjoy and also to inform said person about this Privacy Policy as you will be the only person responsible for communication of said third party data and information with said parties having given their consent or for said data not being used correctly or against the law.
Their consent is not necessary when their data is given to Ayjoy to perfect a contract in their favour.

Ayjoy reserves the right to eliminate accounts and all relative data if they should find any illicit content , damaging to the Ayjoy image and/or its or third party products.

Those who can handle your personal data

Ayjoy has  decided to use third parties to carry out certain activities when handling your personal data. The parties carrying out said operations have been carefully selected and have all the experience, skills and reliability required and offer suitable guarantees fully meeting laws in force on the matter, also from a data safety point of view.
Said third parties do their job based on Ayjoy instructions and under its control. We periodically check that those responsible have done their job correctly and that they continue having suitable requirements fully meeting data protection laws in force.

Your data is then handled by our assignees providing the single services; operator categories providing said services depend on the purpose the data was supplied for and are always indicated in the information we provide when you give us your personal data.

Cookies

Most of the information Ayjoy collects through the website is anonymous, as well as information on pages visited and searches done. During the Ayjoy website visit, no personal data is collected unless specifically authorised by users.
Anonymous information is handled by Ayjoy to improve website content and to draw up aggregate statistics on those visiting our website, thus for internal use and for market research. As part of said activity, Ayjoy could install "cookies" collecting the name of the user’s first level domain  (for example 'provider.it' from an email address such as: name.surname@provider.it), data and time of access. A "cookie" is information sent to the browser and saved on the user’s hard disc.
"Cookies" do no damage to a user’s computer. The user can change his/her browser settings so that it signals reception of a "cookie" thus enabling the user to accept or refuse it.  

Accepting the automatic data collection procedure and use of cookies is necessary for use of the website and its services, including buying products. If you have activated the cookie cancellation procedure, AYJOY cannot guarantee you can see some website pages fully or be supplied certain services.

Safety measures

We take suitable safety measures to reduce to a minimum the risks of destroying or losing – even accidentally -  data, unauthorised access or handling that is not permitted or does not conform to the collection purpose indicated in our Privacy Policy.

However AYJOY cannot guarantee its users that the website safety measures taken, and transmission of data and information in the site, limit or exclude any risk of unauthorised access or data dispersion through devices used by the user: we advise you to make sure your computer  has adequate data transmission software protection, both inwards and outwards (like updated antivirus systems) and that your Internet service provider has taken suitable data transmission safety measures (like firewalls and anti-spamming filters).

Ayjoy does not control or monitor said websites and their content. Ayjoy cannot be held responsible for the content of those websites and the rules adopted by them, also concerning your privacy and the handling of your personal data during navigation. Our Privacy Policy does not apply to third party websites. Law no. 70, 23 May 1995) disciplining the treatment of personal data – also held abroad – guaranteeing a  protection level suited to the person and his/her confidentiality sphere. The Law guarantees that personal data is handled  fully respecting fundamental rights and freedom, and the interested party’s dignity, with special reference to confidentiality, personal identity and the right for personal data to be protected.
